These terms govern your use of Encore, a tour-management application operated by Six Creative Co ("Encore", "we", "us"). By creating an account or using the app you agree to them. If you don't agree, please don't use Encore.
1. Your account
You need an account to use Encore. You must provide accurate information, keep your credentials secure, and be at least 16 years old. You're responsible for everything that happens under your account. Tell us promptly at support@encore-app.com if you believe it has been compromised.
2. Your content
You keep ownership of everything you put into Encore: your tours, schedules, contacts, documents and files. You grant us only the limited licence needed to host, process, back up and display that content so the app works for you and the crew you share it with.
You are responsible for the content you upload. In particular, you confirm that you have the right to store the personal details of any crew member, contact or guest you add, and that doing so does not breach anyone's privacy rights.
3. Acceptable use
Don't use Encore to:
- Break the law, or infringe someone else's rights
- Upload malware, or attempt to breach or overload the service
- Reverse-engineer, resell or white-label the app without our written permission
- Access another person's account or data without their authorisation
- Scrape the service, or use it to build a competing product
We may suspend or terminate accounts that breach these terms.
4. Subscriptions and billing
Encore offers a free tier and may offer paid subscription tiers. Where a subscription is purchased through the Mac App Store:
- Payment is charged to your Apple Account at confirmation of purchase.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period.
- You can manage or cancel your subscription in your Apple Account settings.
- Refunds are handled by Apple under their standard policy; we cannot issue them directly.
Prices may change. We'll give reasonable notice before a change affects an existing subscription.
5. Features under development
Some features, including ticketing, payment processing, the scanner app and published tour pages, are described on our website as planned or in development. They are not part of the current release. We make no commitment as to whether or when any planned feature will ship, and you should not subscribe in reliance on one.
6. Third-party data
Encore surfaces information from third-party sources, including flight schedules and visa requirements. This information is provided for convenience and may be incomplete, delayed or wrong. Always confirm flight times with the airline and entry requirements with the relevant embassy or immigration authority. We are not liable for decisions made in reliance on third-party data.
7. Availability
We work to keep Encore running, but we don't guarantee uninterrupted availability. We may modify, suspend or discontinue features, and we'll give reasonable notice before a change that materially reduces core functionality. Encore requires an internet connection for most features.
8. Your data and backups
We take reasonable steps to protect and back up your data, but you remain responsible for keeping your own copies of anything critical. Encore's PDF export exists for this purpose. Deleting your account permanently removes your data, as described in our Privacy Policy.
9. Disclaimers
Encore is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Nothing in these terms excludes any rights you have under consumer law that cannot lawfully be excluded.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for lost profits, lost bookings, lost revenue or lost data. Our total aggregate liability arising out of or relating to Encore is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty Australian dollars.
11. Termination
You may stop using Encore and delete your account at any time from My Account → Danger Zone → Delete Account. We may suspend or terminate your access if you materially breach these terms, or if we discontinue the service. Sections that by their nature should survive termination will do so.
12. Changes to these terms
We may update these terms. If a change is material we'll update the date above and notify you in the app or by email before it takes effect. Continuing to use Encore after a change means you accept it.
13. Governing law
These terms are governed by the laws of New Zealand, and you and we submit to the non-exclusive jurisdiction of the New Zealand courts. Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply to you.
